Disclaimer. 1a) Gunauction.co.uk, it's employees, associated companies, owners and organisers take no responsibility for the serviceability of items sold or offered for sale on this website except where expressly stated in writing. In all cases we are initially an agent and third party instigator, except where expressly stated in writing. We make no guarantees as to the accuracy of descriptions, fitness for sale and adherence to laws unless we expressly show in writing that this is a service we have undertaken, and in those cases the final responsibility lies with the seller and buyer. We will, however, never knowingly offer for sale or transfer an item we consider unfit for sale. 1b) Gunauction.co.uk, it's employees, owners, organisers and associated companies reserve the ultimate right to withdraw from sale any item, regardless of the description given, actual condition, or fees paid or agreements made. 1c) Sellers must ensure the item they are selling is fit for sale and adheres strictly to any current legislation in force. Sellers must ensure they give an accurate description of the item they offer for sale. Sellers must make their intentions clear on the submissions form; please contact Gunauction.co.uk or Deva Arms Co (Gunsmiths) if any doubt whatsoever. 1d) All fees must be paid within seven days of inclusion on Gunauction. Fees are non-returnable with the exception of administrative errors made by Gunauction. If Gunauction exercises its exclusive and ultimate right of veto over a lot, any fees paid are non-returnable to the seller. Any decision made by Gunauction.co.uk, it's employees, owners and associated companies in the management, organisation, sale and transfer of lots are considered binding and final. 1e) The seller has no control over graphic or text reproduction on the site. Any graphics or text blocks are included at Gunauction.co.uk discretion. While Gunauction.co.uk will strive to include a lot or item formatted to the fee payers request, no guarantee is made. Gunauction.co.uk has final say over graphic and text reproduction on the site. Mistakes will be rectified only if the seller can show cause. Sellers. 2a) No seller has any discretion over fees due, payments to be made or due dates unless expressly arranged with Gunauction.co.uk or Deva Arms Co (Gunsmiths). 2b) If a seller disposes of a lot or item outside Gunauction.co.uk after fees have been paid and an item submitted, no refund will be given. 2c) If Gunauction is requested to handle a sale, and after any fees have been paid, it is the responsibility of the seller to arrange all insurance for transport to Gunaution and while the lot is in the hands of Gunauction. Gunauction takes no responsibility for damage occurring while in transit or in our possession. 3a) Full Page Showcase Auctions are an additional, fee negotiable, service. All rules and terms as contained in other sections also apply to Full Page Showcase Auctions. 3b) It is the sellers responsibility to send photographs or graphics to Gunauction expeditiously to ensure the item is included in the Showcase section as quickly as possible. The graphics or pictures must be of an acceptable quality and Gunauction will not be held responsible for the end result if a graphic is of low quality whether it be as a photograph or graphic sent by e-mail or on floppy disk. 3c) It is completely at Gunauctions discretion which Showcase retains top place on the Showcase section, but in the normal course of events a Showcase will begin at the bottom of the section and gradually work its way to the top in the course of the auction. Top billing may be given to Showcases from the start of an auction only after a fee has been negotiated, but this top billing will only be for a period as decided by Gunauction. Bidders/Buyers All previous rules and terms apply to Bidders and Buyers as outlined above, so please read and understand these even if they appear not to apply to you. 4a) In an e-mail bidding Auction it is the buyers responsibility to ensure they possess the relevant licences and certificates to meet legal requirements for possession of firearms if they bid for a firearm or licensed item, regardless of country of origin. 4b) As 5a and Gunauction makes no guarantee as to the accuracy of a description given by a seller. 4c) It is at the buyer/bidders own risk that they enter into a sale with regards an e-mail Auction. Gunauction acts only as an agent to bring together the buyer and seller and makes no guarantee of the serviceability or legal condition of a lot. BUYER BEWARE! 4d) The transfer of the lot and any money is at the buyer and sellers discretion. Gunauction acts only as the introduction service and has no control over the lot or legal transfer. We recommend using the Paypal service as a secure and efficient means of transferring money between private individuals. 5a) In the UK legal considerations dictate that a firearm cannot be sent to a private individual and it is the buyers responsibility to nominate an RFD who is willing to affect the legal transfer. Most RFDs levy a small charge for this service and it is the buyers or sellers responsibility to meet this charge in full prior to release of the lot. Please check in your own area or country any legal restrictions that may apply to the transfer of a firearm. 5b) Gunauction does not guarantee any lot mechanically, aesthetically or for serviceability. As with any auction, Gunauction meets no warranty conditions in any way. Wanted and Swap Shop 6) Anyone posting a Wanted or Swap Shop ad must understand that it is always treated as a private e-mail Auction unless clearly stated. Finally, enjoy the auction!
